For those who are too lazy to read. A woman that was off of meth for 8 months, not a child, someone who knew full well the effects and harm meth can cause. Decides she needs to do meth again, buys meth overdoses has heart attack and goes into coma for 11 days. Decides to sue the dealer that sold it to her and wins.
And it’s not like the dealer held the meth pipe to her mouth and was like smoke this or I will kill you.

It was wrong for the person to purchase the meth in the first place however sometimes meth can be of different qualities and have chemical characteristics not common in other qualities of meth. Therefore a person can sue for being provided something that the dealer was aware of but the user was not aware of and subsequently suffered as a result of. But hey, even if both were wrong, maybe if dealers realize that they can be sued right and left in addition to criminal penalties, I’m all for it! It might slow dealing just a tiny bit.

If you can sue bartenders for serving to much alcohol, then why not drug dealers. However the girl that overdosed should be in jail as well as the dealer for buying it!
Wrong, reason Plaintiff won was a default judgement. Meth is an illegal product, so it seems such a defective product and lack of warning puts it outside the review by civil litigation.
An exception would be if she was provided a large drug dose intended to cause harm, that the drug dealer intended to put her in a coma or kill her, in which case there were be an assault type charge. That’s not alleged as reported in the article, .
But that’s my logic.
Bars can be sued for drunks. McDonald’s can be sued because their coffee is hot (duh)! Why not sue someone who’s selling an illegal narcotic.
This world has gone lawsuit happy and you can sue for any frivolous thing you want. (not that dealing drugs is frivolous, it’s illegal). Makes it harder for people who have legitimate cases to be taken seriously.

I think it’s her fault. I think that if he’s going to go to court for anything, it should be for selling the drug, not for her od. The problem she had was her’s, and it was her fault for od-ing. I say she should have lost the case, been sent to prison for using the illegal substance, and he should have been sent to prison for dealing.
It would have been better if the parents had sued but yes, this is quite good.
Wrong, she bought the drug so it was then her responsibility to take care of herself when using it. Thats like saying I can sue Nike because I didn’t properly tie my shoes and I tripped (which by the way didnt really happen). He should be charged for selling illegal drugs but thats it. She was responsible for her own actions as soon as she handed him the cash.
In this situation it is not right but sometimes I can understand only because I lost my ex bf due to herion od he was given herion laced with some sort of mophine it is said to be 10 times more deadly than reg morphine and the dealer knew it and killed 6 poeple all to make a buck … sad thing killed two guys who have babies and one 16 yr old girl and is in jail for murder …really sad thing my ex’s MOM found him on her front porch dead on her way to work
I think that its wrong that a drug dealer is getting sued for overdose because the drug dealer didnt put the stuff in the persons body that person was the one who did but the drug dealer should do time for selling the meth.
HAving seen the damage done by meth first hand, It’s not pretty. Anything done legally to stop or slow it down, is interesting, to say the least!
Of course it’s wrong. Personal responsibility is simply that. If you choose to use something that has a high mortality risk, you must deal with the consequences.
