Question by marquita: why is it ok for a cop to be on drugs they arrest people for that?
Our senior drug detective just got out of rehab for using meth, I’d like anything you can tell me as to why this is ok for the cop but not ok for the average guy?

In CA, if you are convicted of a felony, you cannot be a cop. Most departments would not tolerate such behaviors.
I know with the ACSD, you received immediate termination for using illegal drugs – period. One of the best policies I have ever seen in LE.

It’s not okay. The only thing I can think of is that maybe he was undercover and got caught up in using meth as part of his undercover work.
We live in a corrupt society where the law efforcement is above what they stand for… makes you want to throw up, right?
It isn’t ok. He should have lost his job immediatly and I am sure that he will be pushing papers for a while if not fired.
It is not okay, that is why he went to rehab.
Drug addiction is a disease, not a sign of weakness,
I’m all for people to get help if they have an addiction to drugs, but if what you say is true, then he should be dismissed from the force after rehab. On the other hand, many undercover police officers have to blend in to gain the trust of the drug rings, so many might do drugs to hide their cover. It’s an awkward situation to say the least, but if I was in the DEA I would hate to be put in the situation to have to do drugs to fit in without my cover being blown. If he did it on his own, he should be fired.
Using drugs is not okay for anyone. And you can bet that he probably won’t be a narcotics detective anymore.
But, being addicted to drugs is not a crime. Possession of drugs is a crime. So if he voluntarily admitted that he had an addiction and chose to go to drug rehab, he will be allowed to go. He has not been arrested for drugs (that you have mentioned) and so is not a felon. The department cannot take action against someone who is seeking help for an addiction just because what they are addicted to is illegal. That would be punishing them when they have not been convicted of a crime.
The same way that there are lots of people every day around the world who admit themselves to drug rehab. These people are doing it to get better. The police will not, and cannot, arrest someone just for going to rehab. And anything the person says while in rehab will not be used against them towards any criminal charges, due to doctor-patient confidentiality.
To be punished for drug possession, they have to catch you possessing drugs. The detective will likely have to submit to random drug screens in the future, and if caught failing one, will probably be either suspended or fired. But again, not arrested, because they will not have him actually possessing the drugs.
The same would be applied to any person in any job. So the average guy would be treated just like this guy was.

Its not okay. He should have been fired. I’m a cop and I know my city would not tolerate such action.
But, there are cases where a cop and been deep undercover in a narcotics operation and has had to use drugs to keep his cover from being blown. In those cases the officer reports it to hi Chief and after the bust he is placed in rehab and counseling.
O.K.,so you don’t like the guy.A man just coming out of rehab needs a helping hand,not a kick in the teeth.He must have been on the job a long time to become senior drug detective.How much good has he done in the past (*) years?Is he worth keeping or should we just throw him away?
The issue has a “cloud” over it because he’s a cop,its my understanding that cops are people too.He’s been to rehab,think of him as a person.
What is the penalty for a fist time user?
It’s not O.K. for the cop,or the average guy.The difference is,the average guy would be though with it , the “cloud” is going to follow this person the rest of their life.
Do you not believe in giving someone a second chance? Remember, police are human too. Although if he screws up again, I say he should go.
